Mountains Air Solutions – Terms & Conditions of Trade
These Terms & Conditions outline the agreement between Mr Parryd Services Pty Ltd (ACN 656 621 108) trading as Mountains Air Solutions (“we,” “us,” “our”) and you (“the Client,” “you,” “your”) for the supply of goods and services. By engaging our services, you agree to these terms.
1. Quotes & Acceptance
1.1 Provision of Quotes
Based on our discussions with you, we will prepare a Quote, either in writing or otherwise agreed upon (“Quote”).
It is your responsibility to review and confirm that the Quote accurately specifies:
The required goods and/or services.
The agreed price and payment terms.
The requested installation date (if applicable).
Any special instructions or requirements related to the goods or services.
1.2 Acceptance of Quotes
You will be deemed to have accepted the Quote and these Terms & Conditions by:
Signing the Quote.
Making payment or part-payment.
Confirming acceptance in writing (including email & text messages).
Continuing to accept goods or services from us.
Once accepted, the Quote and the Terms & Conditions becomes a binding contract between us.
If any inconsistency arises between the Quote and these Terms & Conditions, these Terms will take precedence unless expressly stated otherwise in the Quote.
1.3 Variations to Quotes
Prices in the Quote may change if additional work or unforeseen circumstances are required to complete your order.
Any additional costs will be discussed and agreed upon before proceeding. We will provide a revised Quote if necessary. Where a revised quote is not provided, the original agreement will continue with the variation.
2. Supply of Goods & Services
2.1 Delivery of Goods & Services
We will supply goods and/or services as specified in the accepted Quote.
All work will be conducted professionally, in compliance with industry standards, and in accordance with any relevant safety regulations.
2.2 Electrical Requirements
You must ensure an electrical power supply is available for installation. If necessary, we may require access to a licensed electrical contractor, as outlined in the Quote.
Any costs associated with electrical requirements will be outlined in the Quote.
2.3 Service Hours & After-Hours Work
Work is generally carried out during standard business hours (Monday - Friday 0800-1600) unless otherwise agreed.
If work is required outside standard hours due to your request or unavailability, after-hours rates may apply. Any extra costs will be outlined and agreed upon in advance.
3. Exclusions
The following items are excluded from the services unless specifically stated in the Quote:
Asbestos & (solid) concrete slab penetrations or removal.
Switchboard upgrades or alterations (neutral links, RCBOs, etc., are not included).
Painting or patching where the new unit does not cover the same space as the existing unit.
Written reports: Reports starting from $110 including GST.
Exclusions do not apply where they form part of your quote.
4. Payment Terms
4.1 Payment Obligations
Payment for goods and services must be made as per the agreed terms in the Quote or invoice.
Unless otherwise agreed, payment is due prior to our departure from site. Failure to pay within the stipulated time will result in additional fees.
Interest of 5% per 14 days will be charged on overdue amounts.
The following payment structures apply:
Service calls & jobs under $500: A $100 deposit is payable upon acceptance via direct deposit. Remaining payable on the day of completion via direct debit prior to our departure from the site.
Jobs over $500: A 50% deposit is payable upon acceptance via direct deposit. Remaining payable on the day of completion via direct debit prior to our departure from the site.
For jobs that require multiple visits, a 50% deposit is payable upon acceptance, followed by a further 40% payment upon completion of the rough-in stage—where the essential wiring, piping, or ductwork is installed but not yet connected or finished—and the remaining 10% is due upon full job completion.
For Strata applications: A $99 fee will be payable for administration and time spent liaising. This is applicable if Mountains Air Solutions provides this information and is not successful with our quote.
The 50% deposits make up: 10% for quote acceptance, 40% for ordering of parts confirmation.
Change of Mind or Cancellation: If you choose to cancel your job with at least one week's notice and do not proceed with an alternative quote from Mountains Air Solutions, your deposit will be refunded minus a 10% quote acceptance fee to cover administration costs and scheduling changes.
Rescheduling: For rescheduling without 48 hours’ notice, you will be charged a $110 admin fee.
4.2 Late Payments & Debt Recovery
If payment is not received by the due date:
Interest of 5% per 14 days will be charged on overdue amounts.
We may engage debt collectors, and you will be liable for all associated recovery costs.
We reserve the right to reclaim unpaid goods from your premises without liability for trespass or damage.
5. Warranty & Returns
5.1 Installation Warranty
Mountains Air Solutions provides a 5-year parts and labour warranty on new installations, provided all required servicing is completed by Mountains Air Solutions in accordance with our recommendations, with servicing performed at an additional cost.
Manufacturers may also provide warranties on goods, typically for a 5-year period, which will be passed on to you.
5.2 Servicing Requirement
To maintain your warranty, all servicing must be completed by Mountains Air Solutions, as specified in your agreement.
Failure to schedule and complete servicing with us may result in warranty cancellation.
5.3 Warranty Exclusions
Warranty claims will not be accepted if the issue results from:
Lack of maintenance or improper servicing.
Fair wear and tear, misuse, or incorrect operation.
Errors in specifications provided and approved by you.
Change-of-mind returns.
5.4 Warranty Claims Process
If you experience an issue:
Contact us with details and supporting images of the issue.
We will inspect and determine whether the claim is covered under warranty.
If approved, we will offer repair, replacement, or refund.
If the issue is due to external factors (e.g., servicing by another provider), we may reject the claim and charge a service fee.
5.5 Consumer Guarantees
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
For major failures, you may be entitled to a refund or compensation for the reduced value.
6. Delivery, Ownership & Risk
Ownership of goods remains with us until full payment is received.
Risk of damage or loss transfers to you upon delivery.
If payment is not received, we may reclaim goods from your premises without liability for trespass or damage.
7. Liability & Indemnity
We are not liable for any loss, damage, or injury caused by goods or services beyond what is covered under Australian Consumer Law.
If you use our products or services in a way that results in legal claims against us, you agree to indemnify us for any resulting losses.
Under no circumstances will we be liable for incidental, special, or consequential damages, including lost profits or business opportunities.
8. General Terms
8.1 Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
8.2 Dispute Resolution
Before pursuing legal action, both parties must attempt to resolve disputes in good faith.
8.3 Subcontracting
We may engage subcontractors to perform work without obtaining prior approval from you.
8.4 Entire Agreement
These Terms & Conditions override any prior discussions or agreements related to the subject matter, unless expressly agreed otherwise in writing.
9. Changes to These Terms & Conditions
We reserve the right to modify or replace these Terms & Conditions at any time at our sole discretion.
If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect.
What constitutes a material change will be determined at our sole discretion.
By continuing to use our services after the revised terms become effective, you agree to be bound by the updated Terms & Conditions.
If you do not agree with the revised terms, you must discontinue using our services.
